Conditions
1. Acceptance of Terms
By booking a photoshoot session, making a deposit, or using any services provided by Flying Art Dubai, operated under Mr Tea FZ LLC ("we," "us," "our," or "Company"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not proceed with booking our services.
These terms constitute a legally binding agreement between you and Mr Tea FZ LLC (operating as Flying Art Dubai). Your booking confirmation, payment receipt, or invoice explicitly references and incorporates these Terms and Conditions by reference.
2. Booking and Deposit Requirements
2.1 Deposit: All bookings require a non-refundable deposit of 25% of the total service fee to secure your photoshoot date and time. The deposit must be paid at the time of booking to confirm your reservation.
2.2 Balance Payment: The remaining balance (75% of the total service fee) must be paid on the day of the photoshoot, prior to or immediately after the session completion. Payment methods accepted include cash and card payments.
2.3 Booking Confirmation: Your booking is only confirmed upon receipt of the deposit payment. Until the deposit is received, the date and time slot remain available to other clients.
2.4 Package Modifications: Any modifications to your selected package (add-ons, location changes, etc.) must be communicated and agreed upon before the photoshoot date. Additional charges will apply as per our current pricing.
2.5 Group Bookings and Cancellations: For group photoshoots, if 1-2 individuals cancel or fail to show up (no-show), the deposit for those individuals is forfeited and cannot be refunded. If the cancellation of 1-2 individuals results in the group size falling into a different pricing tier due to our tier-based pricing structure, the total price may be subject to adjustment at our discretion. The group photoshoot will proceed with the remaining participants, and pricing adjustments will be communicated and agreed upon before the photoshoot proceeds.
3. Cancellation and Rescheduling Policy
3.1 Cancellation and Refund Eligibility: Clients may cancel their booking up to 7 days before the scheduled photoshoot date to receive a full refund of their deposit. Cancellations made less than 7 days before the scheduled date will result in forfeiture of the entire deposit, and no refund will be provided.
3.2 NO REFUND AFTER PHOTOSHOOT: IMPORTANT: Once a photoshoot session has been performed (commenced and completed), there is absolutely no right to a refund for any reason, including but not limited to dissatisfaction with photos, styling, location, weather conditions during the shoot, or any other aspect of the service. Full payment is required regardless of the outcome once services have been rendered.
3.3 No-Show: Failure to appear at the scheduled photoshoot without prior notice will result in forfeiture of the deposit and the booking cannot be rescheduled. No refund will be provided.
3.4 Rescheduling:
- Rescheduling requests made 7 or more days before the original shoot date are free of charge, subject to availability.
 - Rescheduling requests made less than 7 days before the original shoot date may incur a rescheduling fee and are subject to availability.
 - Only one complimentary reschedule is permitted per booking. Subsequent rescheduling requests may incur fees.
 - Rescheduling is subject to our availability and cannot be guaranteed.
 
3.5 Weather-Related Rescheduling: If our photographer determines that weather conditions are unsuitable or unsafe for outdoor photography, we reserve the right to reschedule the session at no additional charge to the client. The photographer's decision regarding weather conditions is final. If a photoshoot proceeds despite challenging weather conditions (at the photographer's discretion), the session is considered complete and no refunds will be provided.
4. Late Arrival Policy
4.1 Grace Period: We allow a maximum grace period of 15 minutes from the scheduled start time for late arrivals.
4.2 Late Arrival Penalty: Clients arriving more than 15 minutes late will be charged a penalty fee of $70 USD (260 AED) to compensate for additional time and potential impact on subsequent bookings.
4.3 No-Show After 30 Minutes: If a client arrives more than 30 minutes late, Flying Art Dubai reserves the right to cancel the photoshoot session and treat it as a no-show. In such cases:
- The deposit will be forfeited and non-refundable
 - The session cannot be rescheduled
 - The full balance remains due if previously agreed upon
 
4.4 Session Duration: Late arrivals will not extend the scheduled session duration. The session will end at the originally scheduled end time to accommodate other bookings.
5. Services and Deliverables
5.1 Service Description: Flying Art Dubai provides professional photoshoot services including but not limited to: photography sessions, flying dress rentals, professional editing, location scouting, and photography assistance.
5.2 Photo Delivery: All photos taken during the photoshoot session will be delivered to the client within 48 hours of the photoshoot completion, unless otherwise specified in writing at the time of booking. Photos are delivered with light color correction applied (not in raw format). Raw (unedited) files are only provided if specifically requested by the client. All photos delivered serve as proof of service completion.
5.3 Photo Selection for Professional Editing: Clients must review the delivered photos and submit their selections for professional editing within a reasonable timeframe. The number of photos that can be selected for professional editing is specified in your chosen package.
5.4 Edited Photos Delivery Timeline: Once photo selections are submitted by the client, edited photos will be delivered according to the following timelines:
- Solo and Duo photoshoots: Edited photos will be delivered within 7-10 working days after submission of photo selections.
 - Group photoshoots (3 or more people): Edited photos will be delivered within up to 20 working days after submission of photo selections.
 
5.5 Delivery Method and Confirmation: All photos (with light color correction and edited photos) will be delivered via official WhatsApp communication containing a Google Drive link. Delivery via WhatsApp with the Google Drive link constitutes official delivery confirmation and proof of service completion. Download links will be valid for a period of 90 days from the delivery date. It is the client's responsibility to download and save all photos within this timeframe. Flying Art Dubai is not responsible for photos that are not downloaded within the 90-day period.
5.6 Number of Edited Photos: The number of edited photos included in your package is specified at the time of booking. Additional edited photos beyond the package allowance may be available for purchase at our current rates.
5.7 Service Completion: Delivery of photos (with light color correction) within 48 hours via official WhatsApp communication with Google Drive link constitutes proof of service completion. Once photos are delivered via this method, the photoshoot is considered complete and no refunds are available regardless of editing status or client satisfaction with the delivered images.
5.8 Quality Standards: We maintain professional standards in all our work. However, the final output depends on various factors including lighting conditions, client cooperation, and location accessibility. Quality concerns must be raised within 7 days of receiving either photos with light color correction or edited photos.
5.9 Photo Loss and Reshoot Policy: In the unlikely event that photos are lost from our end due to technical failure or other circumstances:
- In cases of partial photo loss: Resolution will be determined at our discretion based on the circumstances, and may include partial reshoot, partial refund, or other appropriate remedies.
 - In cases of complete loss of all photos: The client is eligible for either a full reshoot at no additional charge or a full refund, at the client's discretion. This does not apply if the loss is due to client's failure to download photos within the 90-day download window.
 
This policy only applies to technical failures or losses on our end and does not cover situations where services were successfully delivered.
6. Intellectual Property Rights
6.1 Copyright Ownership: Flying Art Dubai retains all copyright and intellectual property rights to all photographs taken during the session, including raw and edited images.
6.2 Usage License: Upon full payment and delivery of final photos, clients receive a non-exclusive, non-transferable license to use the photographs for personal, non-commercial purposes, including social media sharing, personal printing, and family albums.
6.3 Commercial Use: Commercial use of photographs (including but not limited to advertising, marketing, promotional materials, or resale) requires prior written consent from Flying Art Dubai and may be subject to additional licensing fees.
6.4 Model Release and Promotional Use: By participating in a photoshoot, clients grant Flying Art Dubai the right to use photographs for promotional purposes, including but not limited to our website, social media, marketing materials, and portfolio, unless otherwise agreed in writing.
6.5 GCC Residents - No Promotional Use: IMPORTANT: For clients who are residents within the Gulf Cooperation Council (GCC) region (Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, and United Arab Emirates), photographs will NOT be used for promotional purposes, marketing materials, portfolio, website, or social media without explicit written consent. This policy is in place to comply with UAE privacy laws and respect the cultural and religious sensitivities of GCC residents. By default, GCC residents' photographs are excluded from all promotional and commercial use by Flying Art Dubai.
6.6 Photo Modification: Clients may not edit, alter, or modify the final delivered photographs in any way that misrepresents the quality or style of our work without written permission.
6.7 Decency and Religious Considerations: Flying Art Dubai respects cultural, religious, and decency standards in our photography and promotional use of images, in compliance with UAE privacy laws. The UAE has strict privacy regulations protecting individuals' rights to privacy, and photographing individuals without explicit consent can result in legal consequences. If clients express concerns regarding decency, religious considerations, or cultural sensitivity regarding the use of their photographs, these concerns will be addressed and accommodated in our usage of the images. Clients may request specific restrictions on image usage based on decency or religious concerns at any time, and we will make reasonable efforts to accommodate such requests. Our policies are designed to ensure full compliance with UAE Federal Law regarding privacy and personal data protection.
7. Payment Terms and Conditions
7.1 Payment Obligations: All payments must be made in accordance with the payment schedule agreed upon at booking. Failure to make payments as agreed may result in cancellation of your booking.
7.2 Currency: Prices are quoted in USD and AED. Exchange rates are determined at the time of payment. Prices in AED are approximate and may vary slightly based on current exchange rates.
7.3 Additional Charges: Additional services, add-ons, late arrival penalties, or changes to the original package will be charged separately and must be paid according to the payment terms for those services.
7.4 Chargeback Policy: By making a payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Disputes regarding services rendered should be addressed directly with Flying Art Dubai before initiating any chargeback with your financial institution. Unauthorized chargebacks for services that were provided as agreed may result in legal action to recover costs and damages.
7.5 Refund Policy: Refunds are only available if cancellation is made 7 or more days before the scheduled photoshoot date, resulting in a refund of the deposit. NO REFUNDS WILL BE PROVIDED:
- If cancellation is made less than 7 days before the scheduled date
 - After a photoshoot session has been performed (commenced and completed), regardless of any circumstances including client dissatisfaction
 - After photos have been delivered via official WhatsApp communication with Google Drive link (photo delivery constitutes proof of service completion and triggers full payment obligation)
 - For no-shows or late arrivals exceeding 30 minutes
 - For any services that have been delivered (photos with light color correction, edited photos, editing services, etc.)
 - For individual cancellations within group bookings (deposit is forfeited for no-shows or cancellations of 1-2 people)
 
Once a photoshoot has been performed and photos are delivered via official WhatsApp communication with Google Drive link (within 48 hours as specified), full payment is due and no refunds are available under any circumstances. This policy applies regardless of weather conditions, client satisfaction with photos, editing status, or any other factors. The delivery of photos via WhatsApp with Google Drive link serves as definitive proof that services were rendered.
Exception for Photo Loss: The only exception to the no-refund policy after service completion is if photos are lost from our end due to technical failure (see Section 5.9 for details).
7.6 Service Completion: Full payment for services indicates acceptance of the services provided. Any concerns regarding service quality must be raised within 7 days of photo delivery.
8. Client Responsibilities
8.1 Punctuality: Clients are responsible for arriving on time for their scheduled photoshoot. Late arrivals are subject to the Late Arrival Policy outlined in Section 4.
8.2 Cooperation: Clients are expected to cooperate with photographers and assistants during the session, following instructions and guidelines provided.
8.3 Safety: Clients are responsible for their own safety during the photoshoot session. Flying Art Dubai is not liable for injuries resulting from client negligence or failure to follow safety instructions.
8.4 Property Damage: Clients are responsible for any damage caused to rented dresses, accessories, or equipment during the session. Repair or replacement costs will be charged to the client.
8.5 Location Permits: Most locations do not require special permits. However, if a permit is explicitly required for your chosen location, Flying Art Dubai will inform you of this requirement prior to booking confirmation. Clients are responsible for ensuring they have the right to be photographed at the chosen location and following any location-specific rules or regulations communicated by our team.
8.6 Personal Belongings: Flying Art Dubai is not responsible for loss or damage to personal belongings brought to the photoshoot session.
9. Add-On Services
9.1 Availability: Add-on services (including but not limited to: horse rental, camel rental, extra edited photos, extra dresses, makeup services, express editing) are subject to availability and must be booked in advance when possible.
9.2 Pricing: Add-on services are charged separately at current rates. Prices are subject to change without notice, but confirmed bookings will be honored at the quoted price.
9.3 Transportation: Transportation services are included in Desert and Platinum packages. For City packages, transportation is available as an add-on service, priced from $55-65 USD depending on pickup location distance.
9.4 Cancellation of Add-ons: Cancellation policies for add-on services follow the same terms as the main booking unless otherwise specified.
10. Liability and Disclaimers
10.1 Service Limitations: While we strive for excellence, Flying Art Dubai cannot guarantee specific outcomes, poses, or exact results due to various factors including weather, lighting, location accessibility, and client cooperation.
10.2 Equipment Failure: In the unlikely event of equipment failure, we will make reasonable efforts to resolve the issue. If a session cannot be completed due to equipment failure, we will reschedule at no additional charge.
10.3 Limitation of Liability: Flying Art Dubai's liability is limited to the amount paid for the services. We are not liable for indirect, incidental, or consequential damages.
10.4 Third-Party Services: When third-party services are involved (transportation, venues, etc.), Flying Art Dubai is not responsible for the actions, services, or failures of these third parties.
10.5 Force Majeure: Flying Art Dubai is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, severe weather conditions, or other force majeure events. In such cases, affected bookings are subject to rescheduling or cancellation (with deposit refund if cancellation occurs 7+ days before), at our discretion and based on the nature and timing of the force majeure event.
11. Dispute Resolution
11.1 Communication: Any concerns or disputes regarding services must be communicated to Flying Art Dubai in writing within 7 days of service delivery or the occurrence of the issue.
11.2 Dispute Handling: Disputes will be handled directly by Flying Art Dubai. If a dispute satisfies our criteria for resolution consideration, we will seek the best way to resolve the matter fairly. All disputes must be raised through our official communication channels (WhatsApp, email, or website).
11.3 Good Faith Resolution: We commit to resolving disputes in good faith. Please contact us directly before initiating any chargeback or legal action. We require a reasonable opportunity to address and resolve any concerns before external dispute resolution processes are initiated.
11.4 Chargeback Policy and Bad Faith: IMPORTANT: Chargebacks initiated against Flying Art Dubai are considered to be done in bad faith, as all clients explicitly agree to these clearly outlined refund policies during the checkout process. By making a payment, clients acknowledge acceptance of all terms including the refund policy.
Chargebacks initiated without first attempting to resolve disputes directly with Flying Art Dubai may result in legal action to recover costs, fees, damages, and legal expenses. Documentation of services rendered (photographs delivered via WhatsApp with Google Drive links, booking confirmations, communications, invoice records) will be provided as evidence in any dispute resolution process, demonstrating that services were delivered as agreed.
11.5 Governing Law: These Terms and Conditions are governed by the laws of the United Arab Emirates. Any disputes will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
11.6 Business Entity: Flying Art Dubai is operated under Mr Tea FZ LLC, a company registered in the United Arab Emirates. All contracts, agreements, and legal obligations are between the Client and Mr Tea FZ LLC.
12. Modifications to Terms
Flying Art Dubai reserves the right to modify these Terms and Conditions at any time. The terms applicable to your booking are those in effect at the time of booking confirmation. Continued use of our services after changes are posted constitutes acceptance of the modified terms.
We recommend reviewing these terms periodically. The "Last Updated" date at the top of this page indicates when these terms were last revised.

Acknowledgment
By booking our services, making a deposit, or payment, you acknowledge that:
- You have read, understood, and agree to be bound by these Terms and Conditions
 - You understand that refunds are only available if cancellation is made 7 or more days before the scheduled photoshoot date
 - You understand that NO REFUNDS are available once a photoshoot has been performed, regardless of any circumstances
 - You understand the cancellation, rescheduling, and late arrival policies
 - You understand the payment terms and deposit requirements
 - You agree to the intellectual property and usage rights outlined herein
 - If you are a resident of a GCC country (Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, or UAE), you understand and acknowledge that your photographs will NOT be used for promotional purposes, marketing materials, portfolio, website, or social media by default, in compliance with UAE privacy laws and to respect cultural sensitivities
 - You will not initiate chargebacks for services that were provided as agreed without first attempting to resolve any disputes directly with Flying Art Dubai (Mr Tea FZ LLC)
 - You understand that this agreement is with Mr Tea FZ LLC, operating as Flying Art Dubai, and is subject to the laws of the United Arab Emirates, including strict privacy laws that protect individuals' rights
